In the midst of the difficult conditions endured by the Palestinian people due to the passing away of their president, Yasser Arafat, and the continued Israeli aggression against civilians and their property, indicators of a serious deterioration in the security situation are mounting, especially in the Gaza Strip. In a recent incident, armed Palestinians opened fire towards the mourning tent of President Arafat at 6:30pm Sunday 13 November 2004. The place was crowded as top Palestinian officials, including Mahmoud Abbas, were present. Two security guards were killed and seven were wounded as a result.

Al Mezan Center for Human Rights is deeply concerned by this illegal act, which is one episode in a series of acts that marked the absence of security and the rule of law in the OPT. The Center is particularly concerned for the political future of the Palestinian people should such acts continue. At the same time, Al Mezan values with much pride the coherent transfer of authorities within the Palestinian National Authority (PNA) after the death of President Arafat, and considers this experience as a positive start to build on.

It should be emphasized that similar acts that have involved the use of arms within Palestinian communities have left 485 Palestinians killed or injured since 1 January 2002, according to Al Mezan's documentation. This figure calls for immediate action by the PNA to control the spread and illegal use of small arms in the OPT; a consistent demand made by the Center and by Palestinian civil society over the past years. Al Mezan holds the PNA responsible for this deterioration and for the state of insecurity and absence of law enforcement and warns about more deterioration of the internal security situation at this very particular juncture.

Al Mezan, nevertheless, values the Palestinian announcement of Presidential elections on 9 January 2005, a significant step towards bringing into effect Palestinian law and legitimate transfer of authority. The Center, however, calls on the PNA to expand the upcoming election to include the Palestinian legislative Council (PLC) and local government elections, which would constitute one of the valid solutions for the Palestinian political crisis after three years since the expiry of the PLC's mandate, and much credible debate over claims of corruption and financial, administrative and political reform in the PNA. The Center also views elections as a vital tool to reinforce public participation and accountability in Palestine.

Al Mezan Center for Human Rights also calls for a reform in the election law to open the door to maximum participation of political and community groups, and to ensure the best separation of powers and accountability mechanisms. Together, these steps are hoped to eventually enable the realization of a better state of security and ensure the respect of law. Al Mezan believes that legitimate elections should be held in the entire OPT, i.e. the Gaza Strip and West Bank, including East Jerusalem, and believes that Israel's claims that Jerusalem is not part of the OPT is a breach of international law and United Nations resolutions, which do not recognize any changes in the status of the OPT made by Israel.
